When and How Do Mississippi Attorneys Need to Report Their Credit Hours?
Mississippi attorneys must self-report their CLE credits no later than August 15, 2024. Each year, the Mississippi Commission on CLE will mail Mississippi-licensed attorneys a CLE Annual Report Statement showing CLE credits reported for that year. If attorneys have additional CLE credits to report, they can add them to the Annual Report form.
What are the Required Credit Hours and Types in Mississippi?
Attorneys in Mississippi must achieve 12 CLE credits every year, 1 of which must be ethics credits. A minimum of 6 CLE credits must be obtained via live CLE programs.
Do CLE Credits From Previous Years Carry Over?
Yes, 12 unused credits may carry over from the previous reporting period. While credits in the ethics category may carry over, attorneys can only use them to satisfy their general credits requirement — attorneys must earn new ethics credits for the subsequent reporting period.
What Do Newly Admitted Attorneys in Mississippi Need to Do?
Newly admitted attorneys in Mississippi must complete an approved new lawyer program by the end of the second CLE year occurring after their date of admission. This program satisfies the attorney’s CLE requirement for the year of admission and the next CLE year.
The new lawyer program includes 12 CLE credits, including 6 credits in basic skills and 6 credits in ethics/professionalism.
What are the Penalties for Failing to Comply or Report on Time?
As soon as practicable after August 15 of each year, the Mississippi CLE Commission will compile a list of attorneys who have not complied with their CLE requirement. The Commission will serve by certified mail, each noncompliant attorney with an Order to Show Cause, within sixty (60) days, why the attorney's license should not be suspended. The attorney must furnish the Commission with an affidavit indicating that the attorney has complied with the requirement prior to the expiration of the sixty (60) days or set forth a valid excuse for failure to comply with the requirements because of illness or other good cause. At the expiration of sixty (60) days from the date of the Order to Show Cause, the Commission will notify the Supreme Court of Mississippi of each attorney who fails to file a satisfactory affidavit and recommend appropriate sanctions to the Supreme Court, which may include, among others, that the attorney's license to practice law be suspended.
