MN and NJ CLE Rules Changed: Here’s What’s New

Not only must attorneys remain compliant with their mandatory continuing legal education requirements, they must ensure they are aware of any updates to the rules. Here’s what Minnesota and New Jersey attorneys need to know about recent changes to the CLE requirements in their jurisdictions.

Minnesota CLE Update

Minnesota licensed attorneys are required to report 45 CLE credits per three-year reporting cycle. While they previously permitted only 15 OnDemand credit hours for compliance, a recent Order issued by the Minnesota Supreme Court changed these requirements.

Which Requirements Changed?
Rule 6D and 9B(4) of the Rules of the Minnesota State Board of Continuing Legal Education have been amended, allowing Minnesota attorneys to satisfy their CLE requirements by taking up to 30 CLE credit hours OnDemand for the next reporting cycle.

When Do These Changes Take Effect?
The Minnesota CLE requirements changed on January 1, 2021, allowing attorneys in the reporting period following the Order through December 31 to satisfy 30 CLE credits with OnDemand programming.

Additionally, as of January 1, 2024, Minnesota attorneys will be permitted to satisfy all of their CLE requirements through OnDemand CLE courses.

What Do These Changes Mean for Minnesota Attorneys?
By increasing the number of OnDemand credit hours permissible for compliance, Minnesota attorneys have more options available to satisfy their CLE requirements. Attorneys can complete OnDemand credit hours in their own time during the reporting cycle. Live webinars continue to be counted as live courses to satisfy CLE requirements.

New Jersey CLE Update

Which Requirements Changed?
Starting in 2021, New Jersey’s professionalism and ethics requirement has increased from 4 to 5 credit hours. Of the 5 total professionalism and ethics credits required, 2 credit hours must be in diversity, inclusion, and elimination of bias every two-year reporting cycle.

Additionally, New Jersey has waived the in-person CLE requirement until further notice in response to the coronavirus pandemic.

When Do These Changes Take Effect?
The changes to New Jersey’s CLE requirements took effect on January 1, 2021, and are applicable beginning with the reporting cycle ending on December 31, 2021.

What Do These Changes Mean for New Jersey Attorneys?
Attorneys with a reporting cycle that ended on December 31, 2020 are not required to comply with the new requirement until their next reporting cycle. The changes are applicable for attorneys in the reporting cycle that ends on December 31, 2021, and each two-year CLE reporting cycle thereafter.
