Alan S. Wernick
is an attorney, arbitrator/mediator, and writer. He is a Martindale AV-rated attorney and a leading lawyer in computer and technology law. Mr. Wernick is admitted to practice in Illinois, New York, Ohio and Washington DC. He has more than 45 years of experience and leadership roles, including in the practice of law in information technology, intellectual property, and privacy law; as in-house general counsel; with the successful handling of numerous large complex transactions and mergers and acquisitions due diligence, in strategic counseling of clients in the management of their technology and intellectual capital assets, and in dispute resolution including litigation, arbitration, mediation, and appeals. Mr. Wernick's multidisciplinary background in law, technology, and accounting helps clients meet their business objectives and manage their legal strategies and risks. Since 1982, his practice has focused on computer and information technology law, computer systems acquisitions, privacy, cybersecurity, outsourcing, Internet, e-commerce, copyright, trademark, trade secret, and licensing law. Mr. Wernick provides practical legal advice and strategic counseling to clients in a variety of industries in connection with significant transactional, due diligence, and dispute resolution matters involving these issues. He is a prolific writer and presenter at numerous CLE, public, private industry, professional, and trade associations presentations. Mr. Wernick serves in leadership roles in national and international organizations involved with computer and information technology law, privacy, and intellectual property and on the advisory board of legal publications. In addition, he has a technical background in computer programming and a B.S. degree in accounting. Specialties include technical background and work experience in computer programming and as a computer system operator and systems analyst, including work as a research assistant at The Ohio State University doing computer program development and consulting (as well as developing computer-based training courseware) and statistical analysis.

Brian C. Focht
is senior counsel with Shumaker, Loop & Kendrick, LLP in Charlotte, North Carolina. As an attorney with extensive experience in data privacy, cybersecurity, and AI governance, he helps businesses and individuals manage complex legal challenges, from privacy compliance and AI adoption and development to data breach response. A Certified Information Privacy Professional and Certified AI Governance Professional, Mr. Focht addresses the unique challenges posed by emerging technologies and evolving privacy laws and regulations, empowering his clients to innovate securely and responsibly. His practice focuses on providing strategic guidance to businesses navigating the complexities of ensuring that the creation, development, and adoption of new technology complies with legal obligations, a fast-moving target in today's world, including advising clients on compliance with key regulatory frameworks, such as the EU General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), Health Insurance Portability and Accountability Act (HIPAA), Health Information Technology for Economic and Clinical Health Act (HITECH), and emerging laws like the EU AI Act and new state-level privacy laws. Mr. Focht works closely with business leaders and internal teams to develop and implement policies, procedures and notices, negotiate data processing agreements, manage data breach responses, and ensure secure international data transfers. He frequently helps his clients draft technology-related contracts, develop privacy-by-design and secure-by-design systems, and conduct vendor audits to ensure compliance with evolving privacy and cybersecurity standards. Combining his deep understanding of legal compliance with his tech-savvy approach, Mr. Focht assists in the development of AI platforms, mobile applications, Software as a Service (SaaS) products, and online platform design and operation, collaborating with engineers and product teams to ensure seamless integration of legal frameworks into product development. He earned his B.A. degree from University of North Carolina at Chapel Hill and his J.D. degree from Wake Forest University School of Law.

Daniel H. Butler
is a shareholder with Segal McCambridge Singer & Mahoney. He was born in New York City and grew up on Long Island, New York, before attending the University of Michigan and Syracuse University College of Law (cum laude). After graduating from Syracuse Law and working for the asset forfeiture department of the Northern District of New York for over a year, Mr. Butler moved back to New York City in 2016 and began working as a litigation attorney. He practiced for six years at a busy litigation firm in Manhattan and focused his practice on the defense of professionals and in construction litigation, before moving to Southern California with his wife. Mr. Butler remains licensed in both New York and California. He also has experience in insurance coverage litigation. As a practicing litigator in California since 2022, Mr. Butler's practice has remained focused on the defense of financial professionals and attorneys as well as construction litigation. He has experience in all facets of litigation by virtue of exclusively litigating complex professional responsibility and construction matters. Mr. Butler has also successfully resolved dozens of cases for private clients and insurance carriers through mediation and alternative dispute resolution mechanisms. He has been selected as a Super Lawyers Rising Star in New York City for the years of 2020 and 2021, and in Southern California for the years of 2023, 2024, and 2025. This is an award given to only 2.5% of practicing attorneys in the region. Mr. Butler has also been published in USI Affinity's newsletter (2017) and in the Professional Liability Defense Federation's quarterly publication (Vol 1. 2021), with both publications concerning issues pertaining to the defense of professionals.
