Residential Construction Claims Every Litigator Should Know

The “simple” project that spirals into change-order disputes, mechanic's liens, and allegations of defective workmanship. Residential construction disputes are messy, emotional, and expensive - and attorneys are increasingly being asked to step into the middle of them.
This program examines the residential construction cases that generate the most litigation between homeowners, contractors, subcontractors, and insurers. From vague contracts and handshake agreements to abandoned projects, botched renovations, payment disputes, water damage claims, and insurance battles, faculty will walk through the legal and practical issues that arise when home improvement projects go wrong. Loretta Thompson
is a partner at Withers LLP. Her practice includes both commercial and residential real estate matters, including those involving financing and acquiring real estate with digital assets and cryptoassets, and the use of metaverse and NFTs in real estate. Ms. Thompson regularly negotiates and facilitates real estate acquisitions and dispositions and handles tax exchanges for REIT's, public and private corporations, family offices and high net worth individuals. She also has extensive experience negotiating and administrating finance transactions, commercial leasing, property management contracts, construction and design contracts, and development agreements and easements. Ms. Thompson also advises clients on sustainable investing and resilience management for commercial and residential real estate. Her leasing practice focuses on the negotiation and documentation of commercial industrial and office project leases, as well as rental agreements and leases of high-end residential properties. She also has extensive experience working on all aspects of lender-side commercial real estate and construction loans (for private equity, portfolio, institutional, secondary market), including due diligence, drafting loan agreements, and facilitating the pre- and post-closing processes. Amanda Szmuc
is an attorney at Offit Kurman, Attorneys At Law. She represents individuals and businesses in a wide range of litigation matters, with experience spanning commercial claims, general civil disputes, business torts, construction-related litigation, and intellectual property matters. Her clients include corporations of all sizes, entrepreneurs, contractors and subcontractors, and creative professionals. Her experiences include drafting the winning brief that successfully opposed a petition for writ of certiorari before the United States Supreme Court; leading a bid protest where she obtained emergency restraints and ultimately secured both preliminary and permanent injunctions; and serving as first chair in trial court matters, where she prevailed on evidentiary motions excluding thousands of documents from the opposing party's case. She has also represented corporations in mechanics' lien hearings, protecting their rights and defeating counterclaims in full. Her construction practice also includes representing parties in luxury residential construction disputes, where she regularly handles matters involving sophisticated owners, architects, and high-end contractors. In addition to her construction focus, she has substantial experience in zoning and land use litigation. She regularly serves as lead associate on zoning matters, including rezonings, variances, and annexations, and has appeared before local governments throughout Georgia. Her zoning practice includes drafting petitions appealing zoning decisions, preparing findings of fact and conclusions of law, and advocating clients' positions during administrative and quasi-judicial hearings.
