Overview

Legal Lessons From a Twisted Case of One Probate Attorney's Life, Work, and Death

This fascinating course, based on a true story and book, centers on the life, law practice, and violent death of Rolland Comstock, an eccentric Ozarks attorney and world-renowned rare book collector. Follow along as attorney and author James Owen unpacks the multi-year legal saga that followed his murder, including a civil wrongful death trial against his former spouse. We'll explore legal issues spanning estate planning, probate, criminal procedure, and civil litigation - all drawn from one extraordinary Missouri case. Come away with real, transferable lessons for your practice - register today!

  • Estate plans get challenged. Learn the documentation practices that protect clients (and your license) when an attorney becomes a fiduciary and/or a beneficiary.
  • Pet trusts get litigated. Using a real French bulldog heir case, learn the structural considerations that make animal trusts hold up in court.
  • Vulnerable clients need extra protection. See how Velma Brown's estate became a cautionary tale, and what safeguards prevent undue influence claims when a client has no close family.
  • The Fifth Amendment has a civil cost. See how invoking it in discovery was used against a defendant at trial, and how to advise clients facing parallel proceedings.

Abbreviated Agenda

  1. A Real Dog of a Client: Pets, Trust Disputes, and Professional Judgment
  2. Velma's Unusual Bequest: Attorney PRs, Fiduciary Duty, and Independent vs. Supervised Administration
  3. Who Killed Rolland? The Criminal Investigation: Procedure, Evidence, and the Grand Jury
  4. The Civil Trial: Wrongful Death, Fifth Amendment, and Damages
  5. Takeaways, Mistakes, and Lessons Learned
