Overview

When Good Intentions Meet Bad Drafting: Fixing the Incentive Trust Trap

Incentive trusts sound simple in theory - reward the behavior you want and discourage what you don't. In practice, poorly drafted incentives can create some of the messiest problems in trust administration. What counts as "earned income"? How should a trustee verify sobriety, education, employment, or other milestones? What happens when a beneficiary's circumstances change - or when a decades-old condition no longer makes sense?

This practical course shows you how to draft incentive provisions that accomplish client goals without creating an administrative nightmare. Explore income-matching provisions, education and career incentives, sobriety and recovery conditions, entrepreneurship incentives, trustee discretion, verification mechanisms, tax considerations, and more. Walk away with practical drafting strategies for building flexibility into the trust and avoiding unintended consequences. Register today!

  • Draft income-matching, education, employment, sobriety, entrepreneurship, and other incentive provisions.
  • Define earned income, qualifying achievements, verification requirements, exceptions, and other key terms.
  • Build in trustee discretion and flexibility for changing beneficiary circumstances.
  • Spot tax, fiduciary, and administrative issues before they become problems.
  • Learn from incentive provisions that worked - and those that backfired.

Abbreviated Agenda

  2. Drafting Incentive Distribution Provisions
  3. Trustee Discretion and Administration Challenges
